Marriage certificates and copies are issued in Vietnam. Here is what to know if you are in Australia.

What Home Affairs asks for on a partner visaFor the Partner visas (subclasses 820/801 and 309/100), Home Affairs asks married applicants for their marriage certificate or other evidence that the marriage is valid in Australia, and anyone previously married, widowed or divorced for divorce documents, death certificates or separation documents. For a Prospective Marriage visa (subclass 300), it asks for evidence that you will marry within 9 months of the grant; if you marry before a decision, it asks for a registered marriage certificate issued by the relevant legal authority. All documents are translated into English and provided with the originals; translators in Australia must be NAATI accredited.

Who issues itThe commune People's CommitteeA Vietnamese marriage is registered with both partners present, and both sign the Giấy chứng nhận kết hôn. Since 1 July 2025, commune-level People's Committees handle all civil registration, including marriages between a Vietnamese citizen and a foreigner, which were previously registered at district level.

It is issued by the commune People's Committee where the person is registered as resident, or by the Embassy for Vietnamese citizens living in Australia. Do you also translate the certificate of marital status?

Yes. The Giấy xác nhận tình trạng hôn nhân is translated in full, including the purpose written on it and its date of issue, because Vietnamese law limits it to that purpose and to 6 months from issue. To marry in Australia, the Attorney-General's Department lists evidence of date and place of birth, identity, and proof that any previous marriage has ended.

I was divorced in Vietnam. Can you translate the divorce decision?

Yes. A divorce decision or judgment (quyết định or bản án ly hôn) is translated the same way, every page and every stamp. Home Affairs asks partner visa applicants who were previously married for divorce documents, and the Attorney-General's Department says a person divorced overseas should give the celebrant divorce documentation from the country where the divorce was granted.

How long does the translation take?

Do I need an apostille on my Vietnamese marriage certificate?

Home Affairs' partner visa guidance asks for the original documents and English translations and does not mention legalisation or an apostille. Vietnam joined the Apostille Convention with effect from 11 September 2026, so if another authority asks for one, it is issued by Vietnam's Ministry of Foreign Affairs. An apostille is translated as an extra page.
